There is new legislation coming to Florida and many other states regarding where you store your electronic patient data. This is not just about you saving but where the company you use stores the data ultimately.

Effective July 1, 2023, Florida practices are about to be hit with yet another rule you must comply with, the Florida Electronic Health Records Exchange Act (Florida Statutes section 408.051).

In a nutshell, this new regulation makes it illegal to store patients’ health information anywhere other than in the US and Canada. The problem is that you are not only accountable for where YOU store patient data, but you are also responsible for where your third-party vendors save your practice’s patient information.

Many vendors use places outside the USA and Canada and they will not be compliant and is something you should begin noting and getting your data on a compliant service as this will likely soon move to all states.
